I'd counter-sue after having a lawyer draft a letter explaining that her suit is without merit, and he has a signed release from her anyway.

Assuming he has a signed release.

It's too bad the model isn't smart enough to realize she's an idiot.

This is scary when you think about it.  However I'm wondering what his contact looked like with the client.  Also, there is something that doesn't make sense with regards to how the photo got out to start with?

If you think the American justice is the ONLY messed up system, you would be seriously naive. We just don't keep our insanity a secret......:whistle:

Found an article from the Cleveland Plain Dealer (newspaper). It says their agreement was not in writing. The model alleges he sold the photos; the photographer claims the photos were all stolen. Apparently she signed a universal release form that didn't seem to specify what was supposedly agreed on verbally.

I think this shows why it's necessary to read Terms & Conditions on any and every site used to post photos. And if running a photography business, why it's necessary to consult with a lawyer and/or get professional information about contracts, releases, insurance, etc. etc.

In the type of work I've that was not photography related our agency had liability coverage; to be self-employed or running a business it seems necessary to have liability insurance coverage. And - to get everything in writing!

Well something is missing here and I can't put my finger on it. 100% of the sound of it, the contract was ambiguous or more utility base than was was actually needed.

I'm undecided on this one.
