Selling photos taken at professional sporting events?

So if I'm at a sporting event and I happen to get a great shot of a sports celebrity. To sell the photo do I need a model release form from the sports celebrity? How about a sport like auto racing where the drivers are hidden behind helmets? Is a model release form still needed?

Most arena's have regulations on what you can bring in to shoot.

You'll also have to deal with getty's images and reuters.

When the last candle has been blown out
and the last glass of champagne has been drunk
All that you are left with are the memories and the images-David Cooke.

I could be wrong, but to sell the image itself, Most celebs don't stop people from sell their image as long as it is not used without their permission for some other purpose such as advertising.

You cannot however use the person's name at all. Almost all celebs have their names copyrighted so they take very seriously someone using their name on something that is being sold, or on advertising.

I think the general guideline is that if it's for editorial use (publication in a newspaper, magazine) you wouldn't need a release; if it's commercial (making money from using the image) you probably would. Try looking on some websites for pro photograher's organizations like ASMP for sample releases and usage info.

For sports in particular one resource to try is www.sportsshooter.com , it's a site done by pro sports photographers. If you're talking college sports there are lots of NCAA rules and regs, but basically I don't think you can use a player's photo until they're out of eligibility status (unless it's for publication and you might need permission, I'm not sure).

The only one I know about is Getty Images providing all (or almost all) the images for the NHL. The team photographers didn't have much choice but to work for Getty once the NHL signed an exclusive deal w/them. I think it covers images the teams use on merchandise etc. and photos for publications. Seems like occasionally I've seen a picture that that the photo credit wasn't Getty but that seems to be the exception.

It's really not up to the celeb to stop people from selling their image. Celebs are public figures, if they are out in the public and someone takes their picture...that photographer has permission to sell the image.
