How are you permitting your contracts getting signed?

With all the potential crazy clients that we have to worry about these days and what stands up in court, or what get challenges. How do you have your clients sign your contracts? e-sign, hard copy, fax, sign and scan, then email? I guess my main question is if e-signing a contract would be OK these days?

An electronic signature is as good as a physical one, ever since Clinton signed a bill into law. Any overt acknowledgement on record is most likely good enough; I think the only issue is whether a contract is solid and legally binding.

Consult a lawyer.

Other countries may have different laws. Again, consult a lawyer. Or solicitor. Or whatever they may be called in your community.

While what Gary says is true, the courts are behind in acknowledging this. Major surprise there. I personally would be getting them hand signed, this way there is no doubt. While yes it is a pain to do all of the time, their signature on the bottom line is undeniable. The big reason for the Esig was for tax filing purposes so people could electronically file for themselves. But yes it is a legal signature for all intents&purposes, the problem again is if you get a hick/local judge that does not know that. Remember they are the king in their little world, and believe they are god in it. But also as Gary said consult a lawyer, this is because they will have the knowledge if the local magistrates recognize it.
