Client wants to buy the copyright

1 year 3 months ago #747590 by Jackson Rieger
Well this is a first!  I never sell exclusivity and certainly have never sold my copyright.  Honestly speaking, don't even know the first thing about it, which is why I making this post.  Have you sold your copyright to a photo?  What did you specifically do when a client asks this?

This just happened and I told them I would get back with them.  What sort of markup should be added to this image?

Don't sell it. Find out what his plans to use it are, and then authorize his use of it based on his planned need and how many copies he plans for use of it, in a signed legal contract. If he will be using it in a publication, credit for the photo source printed with it, and something like maybe a nickel per copy printed might work. A few hundred million copies printed might let you retire early.  If it's only for a small company brochure, the per copy number could be considerably higher. It all depends on his planned use and should be negotiated. Will he be modifying it, adding advertising logo, etc? Don't sell the full copywrite. It's yours and should be yours forever in your lifetime. You created it and financial compensation and credit should be paid for your effort, unless you choose to donate it's use for charity, etc, but I would still limit it's use based on a signed contract, even if provided free.

No. Then they'd own the copyright and could use the photo from now on - it would no longer be yours.

Try www.asmp.org or PPA for how to license usage of your images and how to write a contract.

Wonder why they want the copyright?? I doubt they understand what that means for a photographer or artist to sell it. Maybe find out how they intend to use the photo to help explain this to them. Draw up a contract to license usage.

If you sell the copyright, they can pretty much do anything they want with it?  I wouldn't.  I would set up some sort of license for use for a specific time, that way you retain control of your image.

Yeah I sent another contract to client, which doesn't involve selling the copyright.  I'm still waiting to hear back from them.

Good, hope that works out for you.  But IMHO, never sell copyright.  Not unless there is a obscene amount of $$ on the table.
