Question about photographing someone under 18 years old

So, here we go.  I have a client who wants bikini shots for her boyfriend who is stationed over seas with the Army.  Like all new potential clients, I send out a basic question sheet.  Most of it's for knowing how they found me with the exception of some bio questions, so I can get to know them.   On the age box, she stated she was 17 years old.  Now just to be clear, although I'm pretty sure of the answer already.  She should have a parent or legal guardian with her, right?  For obvious reasons, this is one of those times I want to be really sure.  This could be a legal issue, so if 100% illegal, I want to make sure I'm covered.

If she is clothed there is nothing illegal about that.  If there is anything of question, have the parents there.  17 year old teens get photos taken all the time.  Nothing wrong with that.

Aside from HIPPA BS, a 17-year-old can't enter into a legally binding contract in the United States, as far as I know. If you have a contract, someone else will have to sign it.

As for being with you at a shoot, if you're a male, I'd suggest having an adult female with you. And/or have her bring a friend. She should have someone there?

Sure that's a somewhat of a grey area.  With you being a male, just as Gary said, I would make sure you have her have a parental figure with her.  To many nightmare situations you read about in the news.

You need to check your states laws regarding this. Some states allow people under the age of 18 to enter into limited contracts, it is not that they are adults. But either way you want them to have an escort with them, and you want an assistant. You can shoot the bikini photos with no problem, but you must be careful of the posing. Many of the underage photographers that got into trouble with clothed shots, did so because the shots were considered as sexual in nature, or provocative. And to tell you the truth they were correct on that, many were blatantly so. I am not a censorship kind of guy, but there is also a responsibility in your freedoms. So check your local laws, and have an assistant that is female to keep you out of trouble.
Oh! And as a side note. On places such as Model Mayhem their minimum age is 16, so this is actually a barometer of how from the age of 16+ the law is different from 16-. If at that age it was a major problem, then those sites would not allow it. It is just a matter of the content.

Where I live parents have to sign for just about anything and everything the child participates in if the child/student is under 18. It's not just taking the photos it's how they might be used (or where they could potentially end up). I'm not even a guy and I would only consider something like this with a parent present at the session and their signature on a contract.
