Legal to take pictures of horses?

Is it legal for me to take pictures of somebody's horses on their land and sell the picture?
Or
Say if I asked permission to take the picture, but don't ask if I could sell it. Then a few months down the road I decide to sell it. Would that be legal?

Best thing to do would be to call your state... Every state has different laws. I would hate to say yes when it's not, or no when it is.

You could also just ask them to take the pic, tell them your intentions, and tell them you will enlarge a print for them in exchange.

I believe it's legal to take a picture of someone's property if you are standing on public grounds. However I do not know the rules on selling the photograph. I think you would need their written permission.

Often times if you just let the person know you are trying to build a portfolio they are more than happy to help and sign a release. In the event you don't know the owner, or no owner is able to be found I have shot the photos I wanted to take and then set out to try and find them. If I can't often times I won't use them except on Facebook or Myspace. With the horses it's usually something that the owners would love photos of. So the idea of trading them images for the privilege to photograph them is a really good idea. I've done this with trees, buildings, and a host of other subjects. Just remember to get a release.

Well as has been said you can shoot the photo of the horse from a pumlic area like the roadway. You can use the photo for your website and for a portfolio. Now where it differs from state to state is for commercial use. If you plan on using it for advertising then you most likely need a release, if you are selling it as say a print then it gets murky. You are best trying to get a release for that as well.
