Getting sued on your own photos when someone steals them

I have taken two thieves to court over stolen images. In both cases, they were scans of negatives and/or slides. When I produced the film, it left the thief with nowhere to go. In the end I recovered about $1,500 and they paid for court costs.

The bottom line is have all your ducks in a row and incontrovertible proof that the image is yours and it will be smooth sailing in court.

In the situation I was referring to, the accused are usually approached first by the accuser and they 1. Are quite sure a law suit is coming. 2. Is a company that has their own lawyers. 

For smaller cases where the accused doesn’t have much money, they wouldn’t be able to afford such shenanigans. 

It’s more about the racket in the industry in general I was speaking on. Should have specified that.
