Photographing in cemetery legal?

9 years 6 months ago #408660 by Mason Katz
I have some friends who have asked me to take some photos of their Halloween costumes in a cemetery near by where I live.  Just making a quick check, is this legal?  Or would special permission need to be picked up from city?

Actually are cemeteries owned by the city? lol, I have no idea.

It varies on ownership. I've done a little cemetery photography and have never had an issue. Just show some respect....

Why so serious?

I like old cemetery's and shoot them once in awhile. But I don't care for shooting them, seem's to me like I'm invading a very personal place. But older one's have some remarkable shot's in them!

I have never had the dead complain at all about it.
As Ernesto said the ownership varies from private to government owned. I have shot at them with no problem. If a caretaker says to leave then do so. If a family member asks you not to shoot near a particular gave then move to another spot. Other than that you are good to go. My one ex loved to do headstone rubbings, and I would photograph while she was looking for the ones she wanted. We never got bothered.

Although I don't have a lot of experience taking photos in cemeteries.  I don't know if you need specific permission.  Well if it's just you a couple people.  I'm guessing you'll be good.  As someone already stated, just be respectful.  Don't go jumping and swinging on the grave stones.

Big picture: the "cemetery" part is irrelevant. The only (well, primary) issue is public vs private property. For private property you are invited onto it at by the owner and are subject to their rules / restrictions / whims. Public property, generally speaking, is fair game.  The trick is knowing which is which.

The appropriateness of shooting in a cemetery is secondary, albeit important. Yes, be respectful, but also know what your rights are and are not.
