Just saw this go by today. Found it interesting that someone has actually tried to contractually bind someone from expressing their opinion. I wonder if this would really be binding?

That's pure insanity. And it makes me nervous about hitting "I agree" so damn fast all the time on everything. It's downright terrifying. I write reviews on Yelp and Google all the time. Yeesh.

Now excuse me as I go through the iTunes TOS and see if I accidentally signed over my soul to Apple.

Nope the company has not right to impose any sort of fine even with that in their policy. It is a straight purchase transaction, and the company has no rights past the right to refuse service. If anything the Palmer's most likely have a right to sue the company for putting out a false credit report to the agencies. If I were them I would get a hold of the Federal Banking regulator, the FTC, FCC (since this was over the wire), and my Congressthings to get it resolved. I would tell the Congressthings that the local media is waiting to see how they respond to such a travesty being perpetuated on them. I would also file a complaint to the SEC about the credit agencies, or at least tell the agencies that I was filing a complaint for not even looking further into the matter, and I would inform them that I had my Congressthings on it as well. But either way I would be getting a lawyer to start filing suit against KlearGear for malicious damage. Its a brave new world. :lol:
