Wikipedia refuses to delete photo as 'monkey owns it'

That monkey ought to be getting rich from that picture by now! I saw this some time ago, seems like a loophole of sorts to say an animal 'owns' it instead of crediting or compensating the photographer in some way. Of course the photographer didn't actually take the picture but set up the camera there to enable animals to explore and interact with it. I guess he would own the photo since he had the idea to do this and enable animals to create photos in this way.

And of course Wikipedia wouldn't dream of waiting for a legal decision before (ab)using the photographer's work.

The other thing here is that not every jurisdiction in the world has quite the same laws, Berne Convention notwithstanding. And then there's the question of whether an animal has the same legal rights as a human, and if not, what happens to the ownership of the image?

They man ought to find a decent barrister and sue, IMO.
