I would agree with your opinion. It's not something I would photograph. At best, it's like a "Peeping Tom" way of obtaining the images. I wonder why he wasn't brought up on those type of charges.... That said, it is something that the legislature needs to take up & clarify...

In the second to last paragraph the judge comments that many people would likely be offended by the intrusive manner used to take the photos, and that would be best addressed by the legislature. Judges can only go by existing laws in making a decision not how they may feel about it. Like many other things that have happened this may change existing laws.

The original intent by the photographer seemed reasonable enough as he was trying out a new lens and taking pictures across the street; then of course one thing led to another. I think from what I saw most of the subjects were unrecognizable, but they obviously recognized themselves and understandably felt violated.

Typically for art exhibits a release isn't needed but I wonder if this might change that. Usually art prints are intended for a buyer's personal use, but now galleries may have the images posted on their website so they become much more public.

I'm of the same opinion.  This is just wrong and soon, like everything else there will be so many laws that will surely tighten up any lose fitting opinions or abilities with this industry too.

 Oh yes, creepy peeping Tom if you ask me.  IMO they need to put the book down on this one.  How would you feel if someone was posting photos of you.  Who knows which ones that weren't published because of nudity or who knows what.  This is a big invasion of privacy if you ask me.

I agree with the court. It is up to the legislators to define the law. If you want privacy from a public viewable space, then you need to secure that privacy with some sort of obstruction.It really does not take that much to do so either. The peeping tom laws are more of someone actually circumventing your privacy measures, ie such as coming on your property to look through a slit in a curtain, or climbing on your wall/fence to see what is behind it in the windows. So now it is in the states court to define the law, or make a new one. While this is something I personally would not do, or shoot. As the law stands it is his right to do so.
