Pictures at a winery

So I was browsing other photographers websites and seen several portraits taken at wineries.
Do these photographers pay a fee to the winery in order to use their facilities or since they are open to the public is it all fair game as long as there are no distinguishing buildings?

What about all of the photographers selling art prints? They are also making a profit indirectly (or directly depending on how you look at it) on someone elses business.

I have taken photos at the Woodford Distillery in Frankfort, KY without issue. They offer excellent tours of this historic site that has been renovated to produce on of the finest bourbons. Check with the individual winery or distillery and ask their policy of tours, photographs and usage. Each probably has their own policy.

I was at a Winery in the North Georgia Mountains last October for a tour & tasting (more just drinking different varieties than taking a tour) & took a number of photos. Granted, I wasn't using the location as a backdrop for portraits, but I had no problems shooting there...I would guess it would be at the discretion of the owners as to taking photos with the facility as a backdrop...Most likely wouldn't mind...
